Ras Al Khaimah Tourism Development Authority 2nd Floor, RAK TDA Offices, Street No 11, Al Marjan Island, Ras Al Khaimah, United Arab Emirates. (“we”, “us” or “our”) shall issue Unit permits for the purpose of operating of the Activities “Holiday Homes”.


OUR CONTRACT

It is essential that you carefully read and understand these terms and conditions (“Terms”), which contain important information. They constitute the contract between you and us for the services provided by us and set out the basis of your legal relationship with us. The Terms also govern your use of this Website. Use includes accessing, browsing, or registering to use our Website. By using this Website, you agree to and accept these Terms. By registering with us for the services provided by us you acknowledge that you have read and understood and that you agree to be bound by these Terms.

PLEASE READ THESE TERMS CAREFULLY. THIS MAY AFFECT YOUR LEGAL RIGHTS. If you do not agree to the Terms, then you must not use this Website or our services.


PRICES AND VALIDITY

1.1   Prices are based on costs applicable at the time the content was uploaded on the Website and therefore may be subject to variations. We reserve the right to adjust prices until you have made full payment for your permit.


CANCELLATIONS AND REFUNDS

2.1 CANCELLATIONS BY YOU

2.1.2 If you wish to cancel your permit registration, notification of cancellation must be given to us in writing.
2.1.2 No refunds will be made if you cancel the application after the permit has been issued.

2.2. CANCELLATIONS BY US
2.2.1 We reserve the right to cancel the permit at any time and will advise you of such cancellation and the reason why.


COMPLAINTS

3.1 If you have any complaint about the online service, you must make it known at the earliest opportunity to us, we will, where possible, take appropriate action. If you are not satisfied with our response you should notify us in writing and we will do our best to resolve the problem.


AGE LIMITS

4.1 People under the age of 18 cannot apply for a Holiday Home Permit.


DISCLAIMER

5.1 By registering and applying for a Holiday Home Permit you accept that you are liable for the unit(s) that you have listed and have lawful permission to register these unit(s) for Holiday Home use.
5.2 You warrant that you have not relied on any representation made by us, which has not been stated expressly in these Terms.
5.3 We will not accept responsibility or liability for any registrations and issuance of Permits which contravene any law or regulation. Registering for a Permit is done so at entirely at your own risk. We do not accept liability for any loss or damage, however caused (including through negligence), which you may directly or indirectly suffer in offering your unit as a Holiday Home with this contract or in respect of a failure or omission on the part of us to comply with its obligations under this contract.
5.4 This disclaimer set out in these Terms does not attempt or purport to exclude, restrict or modify liability arising under applicable laws if, and to the extent, such liability cannot be lawfully excluded.
5.5 We, or our affiliates, subsidiaries, officers, and/or Agents accept any responsibility for any injury, illness, death, loss (including loss of enjoyment and loss of business, profits or employment), damage, expense, cost or other claims or liability of any description whatsoever which results from: (i) any fault of you or any member of your party, (ii) any fault of any third party unconnected with us and the provision of the services for which you have contracted with us; (iii) any force majeure circumstances (as described herein) which are beyond our reasonable control. Nothing in these terms and conditions shall limit or exclude our liability where such exclusion is not permitted under applicable law.

6.1 You agree that you will only use the Website for the registering of a Unit Permit use only.
6.2 We do not guarantee that our Website, or any content on it, will always be available or be uninterrupted. Access to our Website is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of our Website without notice. We will not be liable to you if for any reason the Website is unavailable at any time or for any period.

You are also responsible for ensuring that all persons who access our Website through your internet connection are aware of these Terms and other applicable terms and conditions, and that they comply with them.

(b) use the Website in any way that may lead to the encouragement, procurement or carrying out of any criminal or unlawful activity, or cause distress, harm or inconvenience to any other person;
(c) do anything that may cause damage to the Website or our servers, systems or equipment or those of third parties, nor access or attempt to access any users’ data. You must not attack our Website via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you may be committing a criminal offence under applicable laws and regulations of your country of residence. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. GOVERNING LAW

10.1 This contract and all matters arising from it shall be governed by and construed in accordance with the laws of Ras Al Khaimah, UAE and the courts of Ras Al Khaimah shall have exclusive jurisdiction in relation to any dispute arising under this contract.
